Legality, GDPR and your responsibilities

Is the software legal?

Yes. IQUALIF gives access to information already published and openly available online: it does not bypass any restricted access and does not resell pre-built files. It is designed to fit the applicable framework, including the GDPR (EU 2016/679), CCPA / CPRA and "Do Not Call" rules.

Who is responsible for what

• Our role: provide a technical tool that collects and structures public information, and flag — where the information is public — whether commercial canvassing is allowed.
• Your role: you are responsible for how you use the data. The file is built directly on your machine, so you are the data controller.

Your main obligations

• Purpose — use the data only for a defined, legitimate purpose.
• Legal basis — consent or legitimate interest depending on context; B2C rules are far stricter than B2B.
• Transparency and individual rights — access, rectification, objection and erasure must be available.
• Do-not-call lists — screen numbers against the country's official list before any phone campaign.

Is the data opt-in?

No. This is public information, not contacts who consented to your marketing. Where the directory publishes it, the software shows whether the person accepts canvassing; where it does not, the field defaults to "no" for information only. This never replaces the official do-not-call screening.
